November 2023 Meeting Recap

Our November meetup last Thursday was amazing! Here's a quick overview for those who weren't able to be there 📋

‣Presentation: Duje Kozomara, Data Protection Consultant, consent.hr – GDPR fines in Croatia - what can we learn? 

‣Here are a few highlights:

✔️“GDPR protection isn’t just about checking a box in case of inspection, it’s about collecting and processing data lawfully.”

✔️Prior to GDPR, data protection rules varied by country. The goal is to make personal data protection part of the business culture.

✔️GDPR protects EU residents, as well as EU citizens both inside and outside the EU.

✔️Personal data is any info related to an individual whose identity has been determined or can be determined.

✔️Legal bases for data processing: Contractual obligation (ex. Someone buys a product through webshop), Legal obligation (ex. laws), Legitimate interest (ex. video surveillance), Public Task (ex. government), Consent (ex. web site cookies), Vital interests of the individual (ex. health emergency).

✔️Consent must be freely given, must be specific, and able to be withdrawn at any time as easily as it was given.

✔️Best practices for consent notice on websites:

‣There should be buttons to both Agree and Disagree, which should be the same size, and color, with the same location.

‣Functions (purpose) of consent must be clearly defined

‣Link to full privacy policy must be visible. Privacy policy must be comprehensive, specific, and transparent and detail which data is collected, who has access to it, and what you do with it.

✔️A Data Protection Officer is needed in certain cases based on the volume of data processed

✔️Do not use Gmail as your email client, as Google has made it clear that they have access to your email contents.

✔️ We will add a monthly supplemental meet-up that will be an informal chat about our businesses. The first meet-up is TBD.
